1. Agreement to Legal Terms

We are LaGioia LTD, doing business as 26 Suites Limassol, a company registered in Cyprus (HE14470), located at 7 Kalliopis, Germasogeia, Limassol 4040. VAT number: CY10014470G.

We operate the website https://26suites.com (the “Site”), as well as any related products and services that refer or link to these legal terms (collectively, the “Services”).

These Terms & Conditions (“Legal Terms”) constitute a legally binding agreement between you and LaGioia LTD concerning your access to and use of the Services. By accessing the Services, you confirm that you have read, understood, and agreed to be bound by all of these Legal Terms. If you do not agree, you must discontinue use immediately.

We reserve the right to make changes to these Legal Terms from time to time. We will update the “Last Updated” date above, and your continued use of the Services after any revision constitutes acceptance of the updated terms.

2. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation. Those who access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws.

3. Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the “Content”), as well as the trademarks, service marks, and logos (the “Marks”).

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. No part of the Services may be copied, reproduced, sold, licensed, or otherwise exploited without our prior written permission. Requests should be sent to info@26suites.com.

4. User Representations & Registration

By using the Services, you represent and warrant that: (a) all registration information you submit will be true, accurate, current, and complete; (b) you have the legal capacity to comply with these Legal Terms; (c) you are not under the age of 18; (d) you will not access the Services through automated or non-human means; and (e) your use of the Services will not violate any applicable law or regulation.

If you register an account, you agree to keep your password confidential and accept responsibility for all activity under your account.

5. Booking & Confirmation

A booking is confirmed once you receive a confirmation email with your reservation number. All reservations are subject to availability and the rates displayed at the time of booking. Amendments must be requested in writing and are subject to approval.

6. Payment Terms & Methods

We offer two rate types:

Flexible Rate: 30% deposit charged at booking. The remaining 70% balance is due 5 days before arrival.
Non-Refundable Rate: 100% of the total is charged at the time of booking.

We accept credit/debit cards via Stripe (Visa, Mastercard, American Express). All rates are displayed in Euros (€) and include applicable taxes as shown in the price breakdown.

You agree to provide current, complete, and accurate payment information. We reserve the right to correct pricing errors, even after payment has been received, and to refuse any order placed through the Services.

7. Cancellation Policy

Flexible Rate: Free cancellation up to 5 days before check-in. Cancellations made less than 5 days before check-in, or no-shows, will be charged in full.
Non-Refundable Rate: Cannot be cancelled or modified once confirmed. No refund for no-shows or early departures.

8. Security Deposit

A refundable security deposit of €200 will be collected at check-in via the guest’s payment method on file. The deposit is returned within 7 days after check-out, subject to a property inspection for damages.

9. Pre-Arrival Requirements

Guests must complete an online check-in form prior to arrival. The check-in form requires:

Upload of a valid government-issued ID
A selfie photograph for identity verification and regulatory compliance

A valid payment method must remain on file for the duration of the stay.

10. Check-In & Check-Out

Check-in: from 3:00 PM
Check-out: by 11:00 AM

Early check-in or late check-out is subject to availability and may incur additional charges.

11. Guest Responsibilities

Guests must be at least 18 years of age to book. Guests are responsible for maintaining the suite in good condition. Damage beyond normal wear may be charged to the security deposit or payment method on file. Smoking is strictly prohibited in all indoor areas.

12. Use of Pool, Gym & Jacuzzi

Use of the pool, gym, and outdoor heated jacuzzi is at your own risk.
These facilities are not supervised — no lifeguards or instructors are present.
The jacuzzi is restricted to guests aged 18 and over.
Children under 16 must be accompanied by an adult at all times.
Unsafe behavior (running, diving, use of glass, intoxication) is strictly prohibited.
Facilities may be closed without notice for maintenance or safety reasons.
Guests are fully liable for their use of facilities and agree to indemnify LaGioia LTD for any injury, damage, or misuse.

13. Prohibited Activities

You may not use the Services for any purpose other than that for which they are made available. As a user, you agree not to:

Systematically retrieve data from the Services to compile a collection or database without written permission
Trick, defraud, or mislead us or other users
Circumvent or interfere with security-related features of the Services
Use any information obtained from the Services to harass, abuse, or harm another person
Upload or transmit viruses, Trojan horses, or other harmful material
Use automated systems, scripts, bots, or data-scraping tools
Attempt to bypass any measures designed to prevent or restrict access to the Services
Impersonate another user or person
Use the Services to compete with us or for any unauthorized commercial purpose

14. Third-Party Websites & Content

The Services may contain links to third-party websites or content. We are not responsible for the content, accuracy, privacy practices, or policies of any third-party websites. If you leave our Services and access third-party sites, you do so at your own risk. Purchases through third-party websites are exclusively between you and the third party.

15. Privacy & Data Processing

Personal data is processed by LaGioia LTD for reservation management and service delivery, in accordance with GDPR. We share data only with payment processors (Stripe) and booking technology providers (Guesty) as necessary to fulfill your reservation.

Pre-arrival identity verification data (ID and selfie) is collected for regulatory compliance and guest safety, and is handled in accordance with data protection law.

Booking records are retained for 7 years as required by Cyprus tax law. Marketing communications require your explicit consent.

The Services are hosted in Cyprus and the United States. By using the Services, you consent to having your data transferred to and processed in these locations.

16. SMS & Electronic Communications

By opting into any 26 Suites Limassol text messaging program, you consent to receive SMS messages including order updates, appointment reminders, marketing communications, and special offers. You may opt out at any time by contacting info@26suites.com. Message and data rates may apply.

You consent to receive electronic communications and agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement for written communication.

17. Disclaimer

The Services are provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no guarantees regarding the availability, accuracy, or performance of the Services.

18. Limitation of Liability

Our liability for any claim is limited to €100 or the amount paid for the reservation, whichever is greater. We are not liable for indirect or consequential damages, loss of personal belongings, or damages arising from the use of facilities (pool, gym, jacuzzi).

19. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand arising from: (a) your use of the Services; (b) breach of these Legal Terms; (c) any breach of your representations and warranties; or (d) your violation of the rights of a third party.

20. Term & Termination

These Legal Terms remain in full force while you use the Services. We reserve the right to deny access to the Services to any person for any reason, including breach of these Legal Terms, without notice or liability. If we terminate or suspend your account, you are prohibited from registering a new account.

21. Modifications & Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We may experience hardware, software, or other issues requiring maintenance, resulting in interruptions or delays. We are not liable for any loss or inconvenience caused by downtime or discontinuance of the Services.

22. Governing Law & Dispute Resolution

These Legal Terms are governed by and interpreted following the laws of the Republic of Cyprus.

To expedite resolution, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating formal proceedings. Such informal negotiations commence upon written notice from one party to the other.

If your habitual residence is in the EU and you are a consumer, you additionally possess the protection provided by the obligatory provisions of the law of your country of residence.

LaGioia LTD and yourself both agree to submit to the non-exclusive jurisdiction of the courts of Limassol, Cyprus. Contact us first at info@26suites.com for any disputes.

23. Miscellaneous

These Legal Terms, together with any policies posted on the Services, constitute the entire agreement between you and us. Our failure to exercise any right or provision shall not constitute a waiver. If any provision is deemed unlawful, void, or unenforceable, that provision is severable and does not affect the remaining provisions. There is no joint venture, partnership, or agency relationship created between you and us as a result of these Legal Terms.
